1. Purpose of the license
The purpose of this license is to define the conditions under which the Customer is authorized to use the digital document templates (hereinafter "Templates") purchased on the website www.aptenys.com (hereinafter "the Website").
It applies to any person who has acquired a Template, whether they are:
- a professional Customer (company, consultant, organization, medical device manufacturer, etc.), or
- a private Customer, acting individually for their own learning or personal use.
The purchase of a Template implies full acceptance of this license.
This license supplements the General Terms and Conditions of Sale applicable to purchases made on the Website.
2. Ownership of rights
The Templates, as well as all their constituent elements (texts, structures, tables, boxes, visuals, etc.), remain the exclusive property of Usarea, publisher of the Website and owner of the Aptenys brand. No transfer of intellectual property rights is made to the Customer.
3. Scope of the right of use
The purchase of a Template grants the Customer a non-exclusive, non-transferable, and non-assignable internal or personal use license.
This license authorizes:
- for professional Customers: the use, customization, and integration of the Template into their internal documentation (quality system, procedures, regulatory deliverables, etc.);
- for private Customers: the use of the Template for learning, training, or creating personal documents, without dissemination to third parties;
- the modification of the content to adapt it to the Customer's context or needs.
This license does not authorize:
- the resale, sublicense, sharing, or dissemination of the Template, in any form whatsoever (original file, modified copy, excerpts, screenshot, etc.);
- making it available to third parties (partners, subcontractors, subsidiaries, customers, external consultants, etc.) without prior written agreement from the Publisher;
- the publication of the Template, in whole or in part, on the Internet, collaborative platforms, or multi-company intranets.
4. Duration of the license
The license is granted for an unlimited period, unless terminated due to non-compliance with these conditions. Any violation of intellectual property rights will result in the immediate termination of the license, without prejudice to possible remedies.
5. Updates
Minor updates to the Templates (corrections, reformulations, normative clarifications) may be offered free of charge for 12 months from the date of purchase. Major updates (complete overhaul or significant regulatory evolution) may be offered at a preferential rate.
6. Origin mentions
No "Aptenys / Usarea" origin mention is required in documents created from the Template. However, the Customer is prohibited from deleting or modifying the copyright notices appearing:
- in the file metadata (document properties, footer, or license notices),
- in the advice and tutorial boxes integrated into the templates,
- in the PDF file provided as an illustration.
These mentions are only intended to identify the origin of the template and the protection of copyright.
7. Absence of regulatory guarantee
The Templates are provided as methodological supports. They do not, by themselves, guarantee the regulatory compliance of the medical device or the Customer's project. The adaptation of the content to each situation is the sole responsibility of the Customer.
The Templates do not constitute personalized regulatory advice and do not replace professional support.
8. Termination
The Publisher reserves the right to terminate the license in case of:
- unauthorized use or external dissemination of the Templates,
- a clear violation of intellectual property rights.
Termination entails the immediate removal of the right of use and the Customer's obligation to delete all copies of the Template concerned.
9. Applicable Law
This license is governed by French law. In the event of a dispute, the competent courts will be those of Lille (France).
